Nesae 105-110

105- WE SENT THE BOOK DOWN TO YOU WITH THE TRUTH SO THAT YOU MAY JUDGE BETWEEN PEOPLE ACCORDING TO ALLAH HAS SHOWN YOU, AND NEVER BE AN ADVOCATE TO THE UNTRUSTWORTHY.

106- AND SEEK ALLAH’S FORGIVENESS, FOR ALLAH IS MOST FORGIVING AND MOST MERCIFUL.

107- AND DO NOT ARGUE FOR THOSE WHO BETRAY THEIR OWN SOULS, FOR ALLAH DOES NOT LOVE HE WHO IS A TRAITOR AND A SINNER.

108- THEY MAY HIDE WHAT THEY DO FROM PEOPLE BUT THEY DO NOT HIDE IT FROM ALLAH WHO IS WITH THEN WHEN THEY PLOT WHAT THEY INTEND TO SAY WHICH ALLAH DISAPPROVES, FOR ALLAH KNOWS WELL ALL THEY DO.

109- HERE YOU ARGUED FOR THEM IN THIS LOWER LIFE, THEN WHO WILL ARGUE FOR THEM ON THE DAY OF RESURRECTION, OR WHO WILL BE THEIR REPRESENTATIVE THEN.

110- HE WHO DOES WRONG OR WRONGS HIS OWN SOUL, THEN SEEKS FORGIVENESS FROM ALLAH; HE WILL FIND ALLAH MOST FORGIVING AND MOST COMPASSIONATE.

 

Historical background:

A Muslim house was broken into and had the food arms stolen.  He accused some people.  This lead to a dispute brought before Allah’s messenger prayer and peace upon him and the truth was found out.

Allah the Highest is telling us that His messenger prayer and peace upon him have authority to judge between people and that his judgement is sound for it is guided by Allah the Highest who shows him the right and wrong.

1-    Therefore, for us now, whatever judgements or rules from judgements of Allah’s messenger prayer and peace upon him, they should be taken into our Law, for Allah the Highest showed them to him.  We find our Law both in the Quran and Sunah. 

2-    Never be an advocate of the Untrustworthy.  Therefore, a Muslim should not support the claims of a person one knows or strongly suspects not to be true.  This also applies to advocates, whose job is to defend people, but they should not if they know them to be guilty.

This goes against the principles of the legal system in many countries where the accused should be defended regardless.  One however should always remind himself that they are defending them before Allah who knows the truth, and that no one will be defending them on the Day of Judgement.

3-    Judging between people, whether by a judge, arbitrator, or mediator, should be based on Allah’s Book and the Hadith of His messenger prayer and peace upon him.  Then the judge is most likely to pass the right judgment, but even if he passes the wrong judgement, Allah the Highest will reward him.  Allah’s messenger prayer and peace upon him said: “When the judge passes judgement after doing his best and was right, he will have two rewards, and if he was wrong, he will have one reward”.  (T:Ahkam;2 & D:Aqdiah;2)

4-    Allah the Highest guides the judge, as long as he tries to be just, otherwise, the judge will be with Satan.  Allah’s messenger prayer and peace upon him said: “Allah is with the judge as long as he is not unjust, if he becomes unjust, Satan will be with him”.  (T:Ahkam;4 & Ma:Ahkam;2 & A:5;26;414)

5-    It is therefore that no judge should sit to judge while he is angry, for Satan will be with him then.  Allah’s messenger prayer and peace upon him said: “No judge should judge between two while he is angry”. (B:Ahkam;13)

6-    The Judge should always seek Allah’s guidance and help, as well as for forgiveness, for he knows that he is not infallible.

7-    As for those who plan to commit injustice and do wrong, they forget that Allah the Highest sees, hears and know every thing.  They are only wronging themselves and plotting against themselves.  Their problem is in their weak faith and wicked soul.

Ayah 110 has great hope and comfort for the Muslims and all the believers.  It is that Allah the Highest is most forgiving of sins regardless of how great they are, once a person knows that they did wrong, repent and ask for forgiveness.

Allah’s messenger prayer and peace upon him said: “There is not a person who commits a sin, then does his wadoo and prays two Rakaa then asks Allah the Exalted and the Majestic for forgiveness, who would not be forgiven”.  (D:Wetr;26 & T:Mawaqeet;181 & Ma:Eqamah;193 & A:1;2,9,12)

To pray before asking Allah the Highest for forgiveness expresses both belief and submission to Allah the Highest.  Asking for forgiveness means that one fears Allah’s punishment.  These are all elements of Faith.
